  • Miranda after winning 'Miranda,' per wiki

    "On March 13, 1963, Ernesto Miranda was arrested, by the Phoenix Police Department, based on circumstantial evidence linking him to the kidnapping and rape of a 17 year old girl 10 days earlier......

    Miranda was retried after the original case against him was thrown out, and this time the prosecution, instead of using the confession, called witnesses (including his common-law wife, who testified that he had told her of committing the crime) and used other evidence.

    Miranda was convicted in 1967 and sentenced to serve 20 to 30 years. He was paroled in 1972. After his release, he returned to his old neighborhood and made a modest living autographing police officers' "Miranda cards" which contained the text of the warning, for reading to arrestees. He was stabbed to death during an argument in a bar on January 31, 1976."

    UPDATE: Forgot to add that police brought in a suspect in Miranda's death, and the guy invoked his - right to remain silent. Lacking sufficient evidence, police had to let him go...

        • The house in Cambridge that the brothers lived in (did they both live there?) is about six blocks from where I live. Luckily I was in Seattle from Wednesday to this morning and missed all the uhh excitement. I don't give a good god damn if they read him his Miranda rights when he was captured and considering the fact that he needed so much medical attention I can't imagine he was aware of what was going on.
          I'm unconsoled I'm lonely, I am so much better than I used to be.

            I think that may be a more reasonable explanation for not Mirandizing him immediately. Once the kid is healthy enough to know what is going on, then read him his rights.

            • Well, that, or the fact that they can easily get a conviction without needing any comment from him to be used at trial. So I don't see the relevance in terms of this case.

              Miranda seems more for where cops are guessing at what happened, then finagle a confession out of a dopey suspect - no good if you didn't Mirandize...

                I would hazard a guess that in well over 90% of all criminal cases, then police are guessing/finding puzzle pieces to put together a case. And I would bet it's probably the same in this case...if the kid isn't Marandized, nothing he says can be used against him. And according to Lucky, nothing the police FIND from those statements can be used against him either. Given the fact that he's a US citizen, he must also be tried in a US court, not a military court.

                While I agree that the guy is a total scumbag, I see no reason to undermine the rights that every citizen has for the likes of him. Every time that people say that they don't care if the government doesn't do things by the book, it's chipping away at YOUR rights, and that's a very dangerous road to tread.

                • Yeah they have 48 hours then he'll get Miranda. I am bias because I live here and it affects my people but I'd rather they push the limits of the law on this and get every drip of intel they can squeeze from him. He can't even talk since he tried to kill himself and failed at that. Loser.

                      Yes. Even more strongly, I would think. His rights are our rights. I know it is unsavory to think we have ANYTHING in common with this quasi-man, but if we sacrifice our freedoms for our security (or revenge), we deserve neither. Just Mirandize the dude, line up the jurors and fire up the chair.

                          Any reason? Sure. Because you're afraid he might actually exercise them. You probably don't get quite as good information about other potential plots or devices or other co-conspirators from someone who has invoked his right to remain silent and to obtain an attorney.

                                really, police don't have a solid case here without a confession?

                                and as our resident REAL judge here noted, Mirandizing is not mandatory - it just impacts what statements you can use at trial. where is the chipping away of rights again?
