    I don't think it goes to court. If they're suspended, they can appeal, but it's to binding arbitration, not court. A civil case requires the burden of proof to be met with a "preponderance" of the evidence, but I'm not sure if that would be the same in a binding arb case. One of the legal minds on here could weigh in.

Selig has spent 20 years trying to lessen the power of the union. Anything that loosens the players footing is a good thing in his mind. His lack of foresight and strategy is mind boggling.

        Selig's an ass and a moron. How he was ever put in charge of anything, I'll never know.

        Be that as it may, if players used PEDs, I want them all to pay a penalty. Not a second penalty on the same time-frame PED use, though.
        Considering his only baseball post in the past year was bringing up a 3 year old thread to taunt Hornsby and he's never contributed a dime to our hatpass, perhaps?

                  especially since A-Rod is an admitted cheater, as is Melky. Braun was caught and got off on a technicality.

                        Because he is specifically attempting to punish them without proving their guilt. The union collectively bargained a process which says that if you fail a test, you're suspended. They didn't agree to "also, if you do anything that Bud doesn't like, you can be punished for that too."

                        If Selig can actually get reasonable proof that they're guilty, then yes, string 'em up. But this heavy-handed way of deciding the punishments first and then trying to justify them doesn't sit with me.
