The problem is that there is nothing in the CBA that actually prohibits blatantly doing exactly what the Cubs did.

But with the higher interest in "spirit of the law" concepts and integration of law into social norms and acceptance, and the clause that states “Every contract imposes upon each party a duty of good faith and fair dealing in its performance and its enforcement.”, I thought the Cubs could lose this one.

I've read the article, and it is an interesting take. I generally like her work. I don't question her main premise---it was purely service time manipulation. I don't see how anyone can dispute that in good faith no matter the silly things GM's say to cover their asses when it happens. However, the question is how far the duty of good faith and fair dealing stretches. I am sure MLB's argument was that once arbitrary time deadlines were put in the CBA, it was completely understood that things like this would happen. They happened regularly before the last CBA was agreed. If the MLBPA didn't like it, they should have negotiated something in the CBA to prevent it.
