  • Notary question

If anyone has experience with this type of form please share.

I am trying to get a Texas title for my Mom's car that is now mine (my sister's agreed to the transfer). The car is titled in Alabama. I need to complete a form proving heirship which needs to be notarized. The document has "State of Texas" in the Notary section. But, I will be in Alabama with both my sister's where we can all sign the paperwork and have the document notarized. I doubt I can get my sisters to sign and bring it back to Texas to have it notarized since the Notary wouldn't know if I forged the other signatures. Does the notary need to be in Texas or can the notary be certified in Alabama since that is where we will be when we can all be together to get the forms signed? I called the DMV, but didn't get a straight answer about it. I would think the form has "State of Texas" as a timesaver for the Notary since most of these documents would be completed and notarized in Texas.

    Thanks.

I was a Notary Public in NJ for 6 years until I let my license recently lapse.

As far as I knew (they don't give you a lot of training for this job, lol), it doesn't matter about what kind of document it is, only that you sign in front of the Notary in their proper geographic location and have proper ID. So it shouldn't matter that a Notary of Alabama signs a document that says it needs to be State of Texas, as long as the Notary is licensed in Alabama and you're signing in Alabama. The Notary has a stamp with his or her license number and they will make a log of it in their book (well, at least some states do that).

Thanks Revo. I thought that was the case, but wasn't sure if the form requires to be signed in the state. It would be tough for us to all be in Texas together so I hope it doesn't require a Texas notary.

Yes, but you're going to have to do the heavy lifting and find a good notary.

Or a bad notary. I hear they work just as well.

Bad Notary would be a good name for a Death Metal Band.

I stamped my monitor but it didn't work.

So funny thing about becoming a Notary Public, at least in New Jersey: all you have to do is write a letter to your local congressman, who will then send you a return letter "vouching" for you, and then you fill out a form and file it with the local County Administration office, who will swear you in right then and there.

                  Yup, that's it.
